Progress continues on class action lawsuit for LaVista Walk apartment fire in Atlanta

A significant development has occurred in the class-action lawsuit on the LaVista Walk apartment fire that displaced over 220 residents in Atlanta during Thanksgiving of 2023. Chief U.S. District Judge Leigh Martin May recently certified the class action, stating that the issue of whether the defendants’ actions or negligence led to the fire applies to all residents affected by the incident.

Doug Dean, the lead counsel for the plaintiffs at Dean Thaxton, LLC, expressed optimism about the certification, noting that it paves the way for hundreds of families to finally seek justice in court. The lawsuit alleges that the owners and operators of the property were aware of the inadequate fire safety systems in the building but failed to address the issue. Numerous complaints had been made by residents regarding malfunctioning fire alarms, leading to several false alarms that caused tenants to become desensitized to the alerts.

On the night of the fire, the confusion stemming from past false alarms led to some residents hesitating to evacuate, unsure if the emergency was real. Former residents also claimed that the management was aware of individuals accessing the parking deck and roof to discharge fireworks and firearms, yet they took no preventive measures to address the hazardous behavior.

Two individuals, Charnelle Gunn and Robert Stokes, were arrested on arson and criminal property damage charges after shooting fireworks from the parking deck, which ultimately ignited the blaze. The lawsuit is seeking to hold the responsible parties accountable for their actions and provide restitution for the affected families.
