Court to decide on class-action lawsuit against Whitecaps in B.C. over Messi’s absence

A judge in British Columbia is set to make a decision on the approval of a settlement involving a class-action lawsuit against the Vancouver Whitecaps concerning soccer player Lionel Messi’s absence at a game in 2024. This lawsuit, filed against the team and Major League Soccer, originated from a game that was promoted to feature notable figures like Messi, Luis Suárez, and Sergio Busquets, but they ultimately did not participate.

The proposed settlement stipulates updates to the team’s ticketing protocols and a charitable contribution of $475,000. B.C. Supreme Court Justice Andrew Majawa indicated that this settlement is more advantageous compared to directly distributing funds to the 50,000 class members, as they would receive only minimal amounts individually.

Simon Lin, the class’s legal representative, mentioned that the funds from the settlement would not have substantial meaning for each class member. However, if allocated to charitable initiatives like KidSport BC, these funds could endorse thousands of families’ annual sports fees. Lin argued for Ho Chun, the representative plaintiff, to be given a $2,500 honorarium for his involvement. Despite Mr. Chun receiving negative attention online as a result, Lin emphasized the impact of such adverse publicity, suggesting it could deter individuals from participating in future class-action lawsuits. Justice Majawa acknowledged the significance of online statements, most notably on platforms like Reddit, when considering the risks associated with plaintiffs publicly revealing their identities.

The settlement was the result of a mediation session facilitated by a retired judge the previous year, and Justice Majawa intends to render a decision on Monday morning regarding its approval. Lin spoke about the misinformation circulating online about Chun, emphasizing the damaging effects of such content and how it may impact Chun’s reputation permanently. Such online backlash, including on social media platforms like Reddit, could demotivate other potential plaintiffs from coming forward.

The judge has underway the scrutiny of the settlement’s viability, weighing the potential benefits for the class members against a direct monetary distribution. If the settlement proceeds, it will include adjustments to the Vancouver Whitecaps’ ticketing procedures and a charitable fund allocation. The ruling planned for Monday will formally settle the dispute between the class members and the Vancouver Whitecaps concerning the advertised but unfulfilled promise of Messi’s appearance at the 2024 game.
