Class Action Lawsuit Targets Microsoft Teams for Violating BIPA with AI Voice Data

Microsoft is currently facing a class action lawsuit filed by five Illinois residents who claim that the tech giant’s Teams platform illegally collected and processed voice data. The lawsuit alleges that Microsoft’s real-time transcription feature captures speakers’ voices and analyzes unique biometric characteristics like pitch, tone, and timbre to identify speakers, a process known as diarization. The plaintiffs argue that this practice created “voiceprints” of users without their explicit consent or knowledge.

Led by Alex Basich and Kristin Bondlow, the class action lawsuit centers on violations of the Illinois Biometric Privacy Act (BIPA), a law that regulates the collection, use, and storage of biometric information. The plaintiffs assert that Microsoft failed to inform participants in Teams meetings that their biometric data, such as voiceprints, were being collected, contravening Illinois state law. Moreover, Microsoft allegedly did not disclose the purpose of collecting this data or provide information on how long the biometric information would be stored and when it would be deleted, as required by BIPA.

The lawsuit, Basich et al. v. Microsoft Corp., was filed on February 5, 2026, in the US District Court for the Western District of Washington. It aims to represent a class of individuals who participated in Microsoft Teams meetings while residing in Illinois since March 1, 2021. The potential financial implications of the case are substantial, with the plaintiffs seeking either actual damages or a minimum of $1,000 for each negligent violation, whichever amount is greater.
