Lawsuit filed by families over Arizona Medicaid for autism coverage

A recent development in Arizona’s healthcare sector has left families of children with autism in distress as two major providers of applied behavior analysis therapy are set to lose their contracts with the state’s Medicaid system, AHCCCS.

In response to this imminent loss of therapy services, eleven families have come together to file a class-action lawsuit against AHCCCS. The primary aim of this legal action is to secure an urgent court injunction that would prevent the termination of contracts with two prominent ABA therapy providers in the state, namely Mercy Care and Arizona Complete Health.

The families involved in the lawsuit have emphasized the crucial role that ABA therapy plays in the lives of children with autism. One such parent, Melissa Fernandez, shared her concerns about the impact of losing these essential services on her son, Collin, who was diagnosed with level 3 autism at the age of 2. Fernandez highlighted the transformative effect that ABA therapy had on Collin, stating that it helped him become more engaged with the world around him and participate in everyday activities such as family meals.

The families are urging the Maricopa County Superior Court to intervene and prevent the contract terminations from going ahead, as they fear the detrimental consequences that the loss of ABA services could have on their children. Fernandez expressed her worries about potential regression in Collin’s progress if the therapy were to be abruptly discontinued, emphasizing the critical need for continuity of care in such cases.

While AHCCCS has refrained from commenting on the pending litigation, the organization has assured its commitment to ensuring that its members have access to medically necessary services in accordance with federal and state requirements. Despite this assurance, the families involved in the lawsuit remain steadfast in their efforts to secure the ongoing provision of ABA therapy for their children to safeguard their well-being and development.
