Missoula County will stay in class-action lawsuit against Republic

Missoula County has decided to maintain its involvement in a class-action lawsuit against Republic Services in Missoula District Court over alleged breach of contract and negligent misrepresentation. Vincent Pavish, deputy Missoula County attorney, indicated that the county and its underlying entities, as part of the class, could opt out of the lawsuit but were advised to remain engaged in the legal proceedings.

Pavish highlighted that members of the class, including Missoula County, were concerned about paying for three-yard dumpsters that were found to hold only 2.5 yards of material. The lawsuit was initially filed by LH Residential LLC and Otis Street LLC, collectively known as Montana Crestview, in 2022. The class consists of all Republic Services customers in Missoula County who paid for ‘three-yard’ dumpster services and later discovered that the dumpsters were significantly smaller than advertised.

The primary issue at hand is the discrepancy between what customers are being charged for and what they are actually receiving. Pavish stated that this misrepresentation results in financial harm to the customers, emphasizing the importance of addressing this matter collectively through a class-action lawsuit to ensure a unified remedy for all affected parties.

The lawsuit has gone through various preliminary stages, including the certification of the class by District Court in November 2023. Despite the progress made, the case is still ongoing, with legal proceedings yet to unfold fully. Missoula County’s decision to remain part of the class-action suit aligns with the goal of seeking justice and resolution for all impacted parties involved in the dispute with Republic Services.
