Missoula County still involved in class-action suit against Republic Services

Missoula County will continue to be involved in a class-action lawsuit against Republic Services, following an agreement made on Tuesday in Missoula District Court. The lawsuit alleges that Republic Services committed breach of contract and negligent misrepresentation.

Vincent Pavish, deputy Missoula County attorney, clarified that although the county and its affiliated entities have the option to opt out of the lawsuit, legal counsel advised that they remain part of it. He stated, “You have an option as a member of the class, and you can opt out of the class if you want to, and pursue remedies on your own. There’s lots of litigation to happen yet. We don’t have separate claims we’d want to litigate ourselves, so there’s really no reason for us to litigate it separately.”

The lawsuit was initiated by LH Residential LLC and Otis Street LLC, collectively known as Montana Crestview, who filed the complaint in District Court. Their claim asserts that they were billed for three-yard dumpsters that could only hold 2.5 yards of material. The class of plaintiffs encompasses all Republic Services customers in Missoula County who paid for “three-yard” dumpster services but received substantially smaller capacity than expected.

According to Pavish, the crux of the issue is that individuals were charged for services that were not commensurate with what they received. He explained, “The allegation is that there’s harm because you’re being charged for something you’re not actually receiving.” The legal process involves several preliminary steps, such as defining the class of affected parties to determine eligibility for collective remedial action by the court.

In November 2023, the District Court granted class certification to Crestview, signifying progress in the case. Currently, the lawsuit remains ongoing, awaiting further developments and resolutions.
