Judge rules against Musk, states Trump has not interfered to stop SEC lawsuit

The ongoing legal battle between Elon Musk and the Securities and Exchange Commission (SEC) regarding the billionaire’s acquisition of Twitter in 2022 has hit a roadblock. Despite rumors that former President Donald Trump might intervene on Musk’s behalf, a US district judge recently revealed that Trump has not taken any action to prevent the lawsuit from proceeding. The SEC’s lawsuit, filed during the last days of the Biden administration, demands $150 million in disgorgement, claiming that Musk failed to disclose the acquisition properly, causing harm to other investors.

Musk has vehemently denied the allegations, accusing the SEC of unfairly targeting him and infringing on his free speech rights by compelling him to disclose his intentions. He argued that the amount demanded by the SEC was excessive compared to previous cases and questioned the motives behind the lawsuit. Additionally, he believed that the SEC was politically motivated and part of a harassment campaign against him. Despite Musk’s claims, the judge ruled against him, stating that he failed to prove that he was singled out or that Trump would intervene in his favor.

Musk attempted to connect the lawsuit to a Trump executive order that scrutinized enforcement actions initiated during the Biden administration. However, the judge dismissed this argument, pointing out that the case proceeded despite Trump’s order, indicating that Trump had chosen not to interfere. Furthermore, the judge highlighted that Musk’s claims lacked credibility, especially considering that two of the three current SEC Commissioners were appointed by Trump, undermining Musk’s argument of being targeted by a politicized SEC.

As the legal battle continues, Musk faces challenges in defending himself against the SEC’s claims. The judge rejected Musk’s First Amendment arguments and dismissed his concerns about the statute’s vagueness. The judge emphasized the government’s interest in ensuring market transparency through proper disclosures, suggesting that Musk’s objections were unfounded. Musk’s fate in the lawsuit remains uncertain, as he navigates the legal proceedings without Trump’s intervention.

Despite Musk’s efforts to distance himself from the controversy surrounding his Twitter acquisition, he must address the SEC’s allegations and comply with disclosure requirements. The outcome of the lawsuit will determine whether Musk can successfully defend himself against the SEC’s claims without external interference. As the legal battle unfolds, Musk’s future actions will play a crucial role in determining the final verdict.
