Alleged $300M Ponzi Scheme Uncovered – Radio Station
An Indianapolis financial broker is in hot water after being accused by the U.S. Securities and Exchange Commission of orchestrating a massive Ponzi scheme that defrauded investors of an estimated $300 million. Gerardo “Gerry” Linarducci, 61, formerly a managing partner at Drive Planning LLC and the head of the company’s Indiana branch office, has come under fire for his involvement in the alleged scheme. The SEC filed a civil complaint against Linarducci in federal court in Georgia, where Drive Planning was headquartered.
Linarducci is accused of actively promoting and selling Real Estate Acceleration Loans (REAL), investment products marketed as short-term real estate ventures that promised a guaranteed 10 percent annual return. However, according to the SEC, these assurances were fictitious. Instead of the funds being tied to legitimate real estate lending, new investors’ money was being utilized to pay off earlier investors, the classic hallmark of a Ponzi scheme.
The SEC claims that between September 2020 and May 2024, Drive Planning managed to amass over $336 million from over 2,000 investors nationwide. Linarducci himself is alleged to have raised in excess of $13 million from investors, pocketing more than half of that sum as compensation from the company. Investors were allegedly misled about the nature of the REAL program, which was advertised as a secure investment linked to real estate development, complete with collateral and steady returns. However, it is claimed that these investments were unregistered securities sold without the necessary disclosures.
Linarducci is facing a litany of charges related to violations of federal securities laws, including securities fraud, aiding and abetting fraud, peddling unregistered securities, and operating as an unregistered broker. The SEC is pursuing civil penalties, the return of allegedly unlawfully obtained profits along with interest, and a court injunction to prevent Linarducci from engaging in future securities law breaches.
