Settlement Reached for Class Action Lawsuit Involving Axip Energy Services Data Breach

Individuals who were impacted by the data breach at Axip Energy Services LP between March and May 2024 have the opportunity to receive compensation through a class action settlement. The company has agreed to pay up to $3,000 to settle a lawsuit alleging inadequate protection of personal information during the breach that affected around 7,222 people, including both current and former employees.

To be eligible to file a claim, individuals must meet specific criteria, including residing in the United States and having their personally identifiable information compromised during the specified breach period. Additionally, they must have received a Notice of Data Breach from Axip Energy Services LP around August 21, 2024.

The settlement payout offers several options for class members to choose from, including three years of free three-bureau credit monitoring, a one-time $63 cash payment, and reimbursement for out-of-pocket extraordinary expenses incurred between March 1, 2024, and December 1, 2025. Class members can file a claim online, download a personalized claim form, or mail a printed claim form to the Settlement Administrator by the deadline of March 2, 2026.

In order to submit a claim, individuals need to provide their Claim ID and PIN from the settlement notice, along with supporting documentation for any out-of-pocket expenses claimed. Once claims are processed, eligible class members will receive a paper check by mail to the address provided on their claim form.

The settlement fund breakdown includes costs for settlement administration, credit monitoring, attorneys’ fees, expenses, a service award to the class representative, and payments to approved claimants. The deadline to opt out of the settlement is January 30, 2026, and the final approval hearing date is yet to be scheduled.

Payments and credit monitoring codes for valid claims will be issued approximately 60 days after the final approval date or completion of claim processing, whichever is later. The settlement arose from allegations that Axip Energy Services failed to adequately safeguard personal information, leading to the data breach in question. While the company denies the allegations, it chose to settle to avoid further legal expenses and uncertainty.
