Independent broker accused of participating in $300 million Ponzi scheme

An Indianapolis broker, Gerardo “Gerry” Linarducci, is facing charges from the U.S. Securities and Exchange Commission in connection with a $300 million Ponzi scheme. Linarducci, the former Managing Partner of Drive Planning LLC and head of its Indiana branch office, has been accused of securities fraud. The SEC alleges that he played a significant role in a fraudulent scheme related to the company’s “Real Estate Acceleration Loans” program, known as “REAL.”

The SEC filed the complaint in a Georgia federal court as Drive Planning, based in Atlanta, operated as an investment firm that sought funds from individuals, including some from Indiana. Investors were promised a guaranteed 10% return on their REAL investments, which were presented as real estate loans to developers. However, investors claim that Drive Planning raised over $336 million in a Ponzi scheme.

Linarducci, 61, is said to have collected over $13 million in investor funds himself, with more than half of that amount coming from Drive Planning. The scheme reportedly took place between September 2020 and May 2024, affecting over 2,000 individuals who fell victim to it. Linarducci faces charges of three counts of fraud, one count of aiding and abetting fraud, one count of offering and selling unregistered securities, and one count of operating as an unregistered broker.

This case serves as a reminder of the risks associated with investment opportunities that appear too good to be true. It highlights the importance of conducting thorough research and due diligence before committing funds to any investment scheme. The SEC’s actions in pursuing charges against Linarducci underscore the regulatory body’s commitment to safeguarding investors and maintaining the integrity of the financial markets.

Investors should be vigilant and exercise caution when approached with investment opportunities that promise high returns with low risk. It is essential to seek advice from qualified financial professionals and be wary of investments that do not have proper regulatory oversight. By staying informed and practicing prudence, investors can protect themselves from falling victim to fraudulent schemes like the one allegedly orchestrated by Linarducci.

In conclusion, the allegations against Gerardo “Gerry” Linarducci highlight the prevalence of financial scams and Ponzi schemes in the investment landscape. Investors must remain vigilant and skeptical of opportunities that sound too good to be true. The SEC’s enforcement actions demonstrate the importance of regulatory oversight in protecting investors and maintaining trust in financial markets. It is crucial for individuals to conduct thorough due diligence and seek advice from trusted professionals before making any investment decisions to avoid becoming victims of fraudulent schemes.
