Progression of class action lawsuit for LaVista Walk apartment fire continues

In Atlanta, a class action lawsuit is moving forward involving more than 220 residents displaced by a fire at The Reserve at LaVista Walk apartment complex during Thanksgiving in 2023. Chief U.S. District Judge Leigh Martin May recently certified the class action on November 19, 2025, stating that the central issue of whether the defendants’ actions or inactions led to the fire applies to all residents affected.

Lead counsel for the plaintiffs at Dean Thaxton, LLC, Doug Dean, expressed relief at the certification, mentioning that this step means that hundreds of families will finally have the opportunity to present their case in court. The residents claim that the property owners and operators were aware of the subpar fire-safety systems in the building and failed to take appropriate action in rectifying the situation.

A major concern raised by residents was the malfunctioning fire alarms at LaVista Walks, leading to multiple false alarms that caused tenants to become desensitized. This resulted in some residents hesitating to evacuate when the fire occurred, questioning whether the alarm was legitimate. Former residents have also alleged that the management knew about individuals accessing the parking deck and roof to discharge fireworks and firearms but failed to prevent it.

During the discovery process, documents surfaced indicating that local managers had requested additional security resources, which were denied by the property owners. The fire raged for over eight hours, causing one building to collapse and rendering another inhabitable, leading to their eventual demolition. After the fire, the property was reportedly left unsecured, resulting in widespread looting before residents could retrieve their belongings. In some instances, tenants claimed they were required to sign liability waivers and faced threats of arrest while attempting to salvage their possessions.

Additionally, despite the apartments being uninhabitable, the complex continued to bill tenants for rent and service charges. The certified class consists of all residents listed in the defendants’ leasing records as of November 10, 2023, with individual damages set to be addressed in subsequent legal proceedings following the liability determination.
