Japanese government task force initiates discussions on increased regulations for cryptocurrency assets

A task force established by Japan’s financial regulator has initiated talks to implement stricter regulations on crypto assets, focusing on measures to combat insider trading and safeguard users amid the burgeoning popularity of these assets as investment vehicles.

The Financial Services Agency’s working group aims to develop a comprehensive report detailing the precise rules under the Financial Instruments and Exchange Act, which currently oversees securities like stocks and bonds. Presently, digital currencies, such as Bitcoin, fall under the regulation of the Payment Services Act as a form of settlement.

The proposed guidelines suggest potential inclusion of digital currencies under insider trading regulations to prevent trading by individuals privy to undisclosed information, like an issuer’s financial distress. Additionally, operators issuing crypto assets for fundraising purposes would be mandated to disclose details regarding the supply volume and underlying technologies involved.

Furthermore, the watchdog is contemplating measures to protect users by enforcing crypto asset exchange service providers to establish reserve funds to compensate individuals affected by fraudulent transactions.
