$13.5M Class Action Settlement reached by LexisNexis Risk Solutions in Florida – Claim Depot

Individuals who have been wrongly reported as deceased or have reached out to LexisNexis FL concerning a death notation on their report could be entitled to a minimum payment of $150, with the possibility of receiving up to $1,000 or more as part of a $13.5 million class action settlement.

LexisNexis FL Inc. has opted to settle a class action lawsuit by agreeing to pay $13.5 million. The lawsuit accuses the company of incorrectly classifying living individuals as deceased, a violation of the Fair Credit Reporting Act (FCRA). Who qualifies to make a claim for compensation?

There are two groups of individuals eligible for compensation:

1. Contact members: These are individuals who got in touch with LexisNexis FL between Aug. 11, 2017, and Nov. 4, 2025, to inquire about a deceased notation on a product from LexisNexis FL. For Contact Members to receive payment, there must be a documented inquiry referring to terms such as “deceased,” “death,” or “dead.”

2. Product members: This category includes individuals for whom an identity verification or fraud prevention transaction was carried out by LexisNexis FL from Aug. 11, 2017, to Nov. 4, 2025. The transaction must have returned a deceased notation, and LexisNexis FL’s system must show a deceased notation linked to the person’s identifying details, as sourced from national credit reporting agencies. Product members need to submit a claim form to be eligible for compensation.

Around 1,700 Contact Members and 59,000 Product Members have been identified by the settlement administrator.

What is the amount of the settlement payment?

All class members and approved claimants will receive a pro rata cash payment starting from $150, and potentially reaching up to $1,000 or more, depending on the number of claims submitted. Both Contact and Product members will receive the same payment sum.

How can one apply for a class action rebate?

Contact members do not need to file a claim; they will automatically receive payment once the settlement is finalized. Product members, on the other hand, must submit a claim form to be eligible for payment. These individuals can file a claim online or send a printed PDF claim form by mail to the settlement administrator.

The $13,500,000 settlement fund will include:

– Settlement administration costs: To be determined
– Attorneys’ fees and costs: Not exceeding $4,400,000
– Service award for the named plaintiff: Up to $7,500
– Payments to qualified class members: The rest of the settlement funds

What are the significant dates related to the class action settlement?

– Deadline to exclude/opt-out: March 4, 2026
– Request deadline for reservation: March 4, 2026
– Final approval hearing: March 16, 2026
– Claim submission deadline: May 15, 2026

When can claimants expect to receive the settlement payout?

Payments will be dispersed to eligible class members and claimants in approximately 120 days after the court grants final approval of the settlement.

The class action lawsuit was initiated due to LexisNexis FL allegedly reporting living individuals as deceased, a claim that the company refutes by stating that its reports are not governed by the FCRA. Nevertheless, LexisNexis FL has chosen to settle to evade the cost and risk of ongoing litigation.
