Biohaven Pharmaceuticals shares drop 1.69% due to class-action lawsuit over misleading drug claims

Shares of Biohaven Pharmaceuticals (BHVN) experienced a decline of 1.69% on Tuesday, marking the fourth consecutive day of losses for the company. Over the course of four days, the stock has dropped by 6.62%, reaching its lowest level since April 2023. This downward trend comes in the wake of a class-action lawsuit filed by Levi & Korsinsky, LLP, which alleges that Biohaven misled investors regarding the potential of its drug candidates troriluzole and BHV-7000.

According to the lawsuit, Biohaven was accused of overstating the regulatory prospects for troriluzole, a treatment for spinocerebellar ataxia, and exaggerating the efficacy and readiness of BHV-7000 for bipolar disorder. These misleading claims resulted in artificially inflated stock prices between March 2023 and May 2025, leading to investor losses. Despite the recent stock price decline, a historical analysis of buying BHVN shares at recent lows and holding for one week showed a return of 15.04% over five years, significantly underperforming the benchmark return of 61.05% with an excess return of -46.01%.

The litigation against Biohaven has brought to light the alleged material misstatements and omissions made by the company, including the failure to disclose critical risks such as adverse clinical trial outcomes and regulatory obstacles. By withholding this vital information, Biohaven is accused of creating a false narrative of success that damaged investor trust and triggered the sharp decline in its stock price. This case also raises concerns about transparency in the biopharmaceutical sector, emphasizing the importance of open communication about clinical data and risks to maintain investor confidence.

Legal experts suggest that this lawsuit could potentially have significant implications for securities litigation within the industry. The outcome of this case may influence corporate disclosure practices and regulatory oversight, setting a precedent for how biotech companies communicate information about drug development timelines and commercial viability. Investors who purchased Biohaven shares between March 24, 2023, and May 14, 2025, have until September 12, 2025, to seek appointment as lead plaintiff in the lawsuit. This case may lead to a reevaluation of how companies manage expectations surrounding their product pipelines and revenue forecasts, especially for firms with limited sources of income.
