SEBI Chief declares zero tolerance for market manipulation

Sebi’s chief, Tuhin Kanta Pandey, emphasized the severity of market manipulation, stating that such actions will not be accepted. Following an interim order against the New York-based Jane Street hedge fund manager, Pandey highlighted the increased surveillance measures implemented by both the regulator and exchanges.

Regarding the possibility of similar behavior among other foreign portfolio investors, Pandey reaffirmed Sebi’s zero-tolerance stance towards market manipulation. The recent directive by Sebi barred the Jane Street Group from participating in securities markets and instructed them to disgorge illegal gains amounting to Rs 4,843 crore for their alleged manipulation of stock indices through derivative positions. This ruling represents one of the largest disgorgement amounts ever mandated by Sebi.

In response to the outcome, the regulator has prohibited entities associated with the Jane Street Group from trading until further notice, indicating that the investigation is ongoing. Addressing an audience at an event organized by the Bombay Chartered Accountants Society, Pandey stressed the importance of transparency in disclosing related party transactions, managing conflicts of interest, and promptly reporting material developments as essential responsibilities for Chartered Accountants.

He cautioned against reducing corporate governance to a mere checklist, underscoring the critical role played by CAs in upholding these standards. Pandey also advocated for a balanced approach to compliance, acknowledging that excessive information and regulations could lead to undue burdens without serving the intended purpose. He emphasized the need for efficient results through streamlined processes, suggesting that suggestions for improvement in this regard are welcomed.
