Nintendo of America Introduces Policy Requiring Users to Waive Rights to Class-Action Lawsuits
Nintendo of America has recently implemented a new policy in its End User License Agreement (EULA) that requires users to forfeit their right to participate in class-action lawsuits against the company. This move comes in response to previous legal challenges related to Joy-Con drift issues experienced by users of the Nintendo Switch.
One of the most significant controversies surrounding the Nintendo Switch was the prevalence of Joy-Con drift, a problem that resulted in two class action lawsuits being filed against Nintendo in 2019 and 2020. Despite the release of the new Joy-Con 2 controllers, which feature redesigned sticks, there is no concrete evidence that the drift issue has been completely resolved for the upcoming Nintendo Switch 2.
Concerned users on platforms like Reddit have pointed out the inclusion of a new clause, Clause 16, in the EULA for US Nintendo accounts. This clause explicitly states that users and Nintendo agree to settle disputes through arbitration on an individual basis, waiving the right to pursue legal action through class-action lawsuits. Nintendo recommends that users resolve any issues by contacting customer service, emphasizing that most matters can be resolved satisfactorily through this channel.
While users have the option to opt-out of the arbitration requirement by providing written notice to Nintendo within 30 days of agreeing to the EULA, the company is taking measures to mitigate future legal challenges. This change mirrors a similar clause in Disney’s terms of service for Disney+, which faced criticism and backlash after being used in a lawsuit following a tragic incident at Disneyland.
