Additional $19 million added to PacifiCorp’s wildfire case toll due to new verdicts

New developments in the legal battle over the 2020 Labor Day wildfires have dealt Portland-based utility PacifiCorp a considerable blow, with the latest verdicts adding $19 million to the company’s liability. The recent damages trial in Multnomah County Circuit Court saw nine plaintiffs awarded $10.8 million for pain and suffering, along with an additional nearly $2.4 million for property damages.

This outcome is part of a longstanding class-action lawsuit against PacifiCorp, with earlier verdicts costing the company an average of around $6 million per plaintiff. The most recent awards bring PacifiCorp’s total liability in the case, known as the James case, to approximately $345 million for about 60 plaintiffs. However, the legal ordeal is far from over for the utility company.

The legal saga began in 2020 when a jury found PacifiCorp grossly negligent and reckless in contributing to four wildfires. Part of the blame was attributed to the company’s decision not to shut off power in hazardous conditions, leading to the devastation caused by the wildfires. As a result, PacifiCorp is now facing damages-only mini trials, with six more trials slated for this year, each involving up to 10 plaintiffs.

PacifiCorp’s parent company, Berkshire Hathaway, helmed by Warren Buffett, has been embroiled in the legal battle through its subsidiary Berkshire Hathaway Energy. Despite the mounting financial toll from the verdicts, PacifiCorp has lodged appeals against the initial and subsequent rulings, putting any payment obligations on hold.
