Supreme Court Supports Rajasthan Electricity Regulatory Commission’s Open Access Rules

The recent decision by the Supreme Court regarding the Rajasthan Electricity Regulatory Commission’s (RERC) 2016 open access regulations has significant implications for industrial consumers. In a judgment delivered by Justices Vikram Nath and Prasanna B Varale, the court dismissed various appeals from industrial entities challenging the RERC regulations.

The Rajasthan High Court had previously upheld the legality of the RERC (Terms and Conditions for Open Access) Regulations in 2016. These regulations were intended to address issues related to the simultaneous use of open access electricity and contracted demand from distribution licensees. The regulations imposed penalties for non-compliance to prevent over-withdrawal and under-withdrawal of power. However, some industrial companies, including Hindustan Zinc Limited, raised concerns about the impact of these regulations on their operations and captive power generators.

The affected companies argued that the restrictions on using open access electricity alongside contracted demand were arbitrary and violated the Electricity Act, 2003. They claimed that the 2016 regulations limited their ability to manage power consumption efficiently from multiple sources, a flexibility they had under the 2004 regulations.

In delivering the judgment, Justice Nath, in an extensive 83-page document, emphasized that the RERC was within its statutory rights under the Electricity Act, 2003. The court determined that the regulations were necessary to promote fair competition, grid discipline, and stable power distribution.

The judgment underscored that the advance scheduling requirements and penalties for deviations were essential to prevent market manipulation and ensure the reliability of electricity supply.
