Proposed Law Would Ban US Politicians from Investing in Memecoins, Dubbed MEME Act

A group of Democratic House members, with Californian Congressman Sam Liccardo at the forefront, are working on a legislative proposal that aims to prevent public officials from endorsing or supporting cryptocurrencies, securities, or commodities. This legislation, called the Modern Emoluments and Malfeasance Enforcement (MEME) Act, was born in response to President Trump and his wife Melania’s launch of two memecoins that primarily benefitted insiders while harming ordinary investors.

The MEME Act, spearheaded by Congressman Sam Liccardo, seeks to address the risks of corruption and unethical practices that accompany the promotion of memecoins and other financial instruments by elected officials. The central idea is to hold public officials accountable and prevent them from leveraging their positions for personal financial gains at the expense of the public.

Congressman Liccardo’s primary concern lies in the exploitation of ordinary investors by influential figures like the Trumps and the potential implications of corruption and insider trading associated with such actions. By introducing the MEME Act, Liccardo and his Democratic colleagues intend to establish clear boundaries to protect the public’s interests and prevent any misuse of political authority for personal enrichment.

The MEME Act, which is set to be presented to Congress soon, is particularly inspired by the launch of memecoins like $TRUMP and $MELANIA. These coins, initiated by members of the Trump family, witnessed a surge in value post-launch, only to plummet subsequently, leaving retail investors at a loss. Liccardo pointed out the disproportionate benefits reaped by insiders through these memecoins, underscoring the need for regulatory measures to curb such practices.

The proposed legislation also extends its scope beyond memecoins to encompass all digital assets, securities, and commodities, aiming to prevent public officials from promoting or associating with these financial products. Liccardo emphasized that the MEME Act would impose both civil and criminal penalties retroactively, prohibiting figures like Trump from profiting from their existing memecoins.

Moreover, in the broader regulatory landscape, SEC’s Crypto Taskforce Director, Hester Peirce, has stated that several memecoins fall outside the SEC’s regulatory purview, indicating the need for oversight by other regulatory bodies like the Commodity Futures Trading Commission (CFTC). This shift in regulatory focus aligns with mounting concerns surrounding memecoins and the steps required to safeguard investors from potential risks and manipulations.
