SECP to provide FIA with information on insider trading and market manipulation cases
The Securities and Exchange Commission of Pakistan (SECP) has made a significant decision to cooperate with the Federal Investigation Agency (FIA) by providing information on completed investigations and filed criminal complaints related to insider trading and market manipulation cases.
According to a spokesperson from the SECP, this decision comes in response to the FIA’s request for details on cases involving insider trading and market abuse to conduct parallel investigations under the Anti-Money Laundering Act, 2010 (AML Act, 2010). It is important to note that the referral of cases does not imply any accusations towards the companies or brokerage houses involved in the manipulation of stock or trading activities. Instead, it focuses on individuals found guilty of insider trading and market manipulation as defined in the Securities Act, 2015.
The SECP has been diligently investigating instances of insider trading and market manipulation and subsequently filing criminal complaints in court under the Securities Act, 2015. The FIA is entrusted with investigating money laundering in predicate offenses under the AML Act, 2010, and insider trading and market manipulation are among the offenses covered under this mandate.
The spokesperson highlighted that the information regarding these cases is public and forms part of the judicial record, accessible to any authority or individual through the court of law. As part of the Anti-Money Laundering (Referral) Rules, 2021, the SECP shared a list of 27 cases with the FIA to enable them to carry out their investigations effectively.
This collaborative approach between the SECP and FIA signifies a commitment to combat financial crimes and uphold the integrity of the securities market in Pakistan.
