FIA seeks information on insider trading and market manipulation cases in Pakistan

The Securities and Exchange Commission of Pakistan (SECP) has agreed to provide information regarding cases of insider trading and market manipulation to the Federal Investigation Agency (FIA) upon the FIA’s request. These cases will also be subject to parallel investigation by the FIA based on the Anti-Money Laundering Act, 2010 (AML Act, 2010) regulations.

It is important to note that the referral of cases to the FIA does not imply any accusations against the companies or brokerage houses involved in the trading activities. Instead, the focus is on individuals found to have engaged in insider trading and market manipulation, as outlined in the Securities Act, 2015. SECP, as part of its responsibilities, has been actively looking into cases related to insider trading and market manipulation and taking legal action by filing complaints in court under the Securities Act, 2015.

The FIA, on the other hand, has the authority to investigate money laundering aspects related to predicate offenses under the AML Act, 2010, including insider trading and market manipulation. The information pertaining to these cases is considered public as it is part of the judicial record and can be accessed by any authorized entity or individual through the appropriate legal channels. Recently, a list containing 27 such cases was shared with the FIA in compliance with the Anti-Money Laundering (Referral) Rules, 2021.
