FERC Proposes Penalty for Alleged Energy Efficiency Resource Capacity Market

On December 16, 2024, the Federal Energy Regulatory Commission (FERC) made a big move, proposing massive civil penalties against American Efficient, LLC and its partners for allegedly manipulating capacity markets. The proposed penalty? A jaw-dropping $722 million, plus an additional $253 million to be handed back. This all stems from an investigation that kicked off in 2021 focusing on American Efficient’s involvement in the capacity markets run by PJM Interconnection, L.L.C. (PJM) and the Midcontinent Independent System Operator, Inc. (MISO).

What went wrong? It seems that American Efficient may have messed up by not meeting the requirements to participate as “Energy Efficiency Resources” (EER) in these markets. Companies had to commit to reducing demand, and according to the FERC Enforcement Staff Report, American Efficient may have overestimated the demand reduction linked to the sale and installation of certain energy-efficient products. They reportedly didn’t have the right relationships with customers buying these products or own the products that were supposed to save energy, making them ineligible to play in these markets.

This is a big deal because the proposed penalties are huge, making up a whopping 80% of all civil penalties handed out by FERC between 2007 and 2024. American Efficient has been called out for expanding its market reach even after being disqualified from other capacity markets, suggesting some tricky business.

Looking ahead, American Efficient has 90 days to respond to the allegations and the big penalties. FERC is serious about enforcing the rules and ensuring that companies in these markets play fair. It’s a reminder that playing by the rules is essential, especially in markets where reliability and fairness are crucial.

In the end, this proposed penalty is a landmark move by FERC, showing that they’re focused on holding companies accountable and making sure that everyone plays by the same rules. Don’t mess around in the energy markets—FERC is keeping a close eye on you!
