Super73 Faces Lawsuit Over E-Bike Legality in California

Super73, a popular e-bike manufacturer, is currently under fire as a California resident, Hillary Whitman, has filed a class-action lawsuit against the company. The lawsuit, filed in Marin County Superior Court, alleges that Super73’s e-bikes can exceed the maximum speed allowance for a micromobility device. Whitman’s complaints include claims of negligent and intentional misrepresentation, as well as false advertising, stating that Super73’s models are marketed as e-bikes but are actually considered motor vehicles.

Super73 offers e-bikes with different modes, including Class 1, Class 2, and Class 3, each with varying speed capabilities. However, an Off-Road mode can be unlocked via the Super73 app, allowing for speeds above the legal limit set by California state law. The lawsuit points out that law enforcement officers have observed Super73 e-bikes traveling at speeds well beyond the legal limit.

California law dictates that e-bikes must fall within specific speed and motor wattage requirements to be classified as e-bikes and not motor vehicles. A new law coming into effect aims to address out-of-class e-bikes and prevent the sale of switchable models that can exceed legal speed limits. Whitman, the plaintiff in the case, purchased a Super73 e-bike for her son’s birthday, only to later find out that it was not legally classified as an e-bike.

In addition to seeking class-action relief, Whitman is requesting reimbursement for the cost of the e-bike, punitive damages, legal fees, and a declaration that Super73’s vehicles are not compliant with California e-bike laws. Super73 has yet to comment on the lawsuit but has indicated that they will respond in due course.

Bob Mittelstaedt, a concerned Marin County resident and advocate for e-bike regulations, has raised issues regarding Super73’s products. He likens the situation to giving children access to cars capable of high speeds, highlighting the need for manufacturers to adhere to e-bike regulations.

As the case unfolds, it remains to be seen how Super73 will address the allegations made against them. Time will tell how this legal battle will play out.
