Moscow judge dismisses class action lawsuit by WhatsApp users against Roskomnadzor

A recent ruling in Moscow dismissed a class action lawsuit filed by a group of WhatsApp and Telegram users in Russia against the Roskomnadzor state media regulator and Digital Development Ministry. The lawsuit, brought forward by Kaluga activist Konstantin Larionov and several dozen co-plaintiffs, challenged government-imposed restrictions on voice and video calls on the messaging apps, alleging violations of their constitutional rights, such as freedom of information and communication secrecy.

The Moscow municipal judge handling the case determined that Larionov failed to demonstrate proper authorization to represent Telegram and WhatsApp users in defending their rights. Despite this setback, Larionov expressed his intention to pursue the lawsuit further, with plans to appeal the judge’s decision. The plaintiffs argue that government data indicating traditional mobile phone calls and text messages as primary channels for fraudulent activities undermines the rationale for restricting calls on messaging platforms.

Larionov, known for his past involvement in pro-peace political campaigns, criticized the restrictions on WhatsApp and Telegram calls as politically motivated. Describing his fellow plaintiffs as ordinary Russian citizens frustrated by the inability to utilize messaging apps for calls, Larionov emphasized his commitment to using his efforts to promote positive change within society.

Larionov’s sentiments were echoed in a statement to the online news outlet Bereg, where he highlighted the challenges faced by activists and politicians in Russia while underscoring his determination to contribute to societal improvement through his advocacy work. He dismissed the notion of halting his endeavors, emphasizing the importance of continuing efforts to benefit society.

Despite the legal setback, Larionov and his group of co-plaintiffs remain resolute in challenging the restrictions on messaging app calls imposed by Roskomnadzor.
