Business Insider files lawsuit against Google for monopolizing adtech, seeks compensation and change.
Business Insider has taken legal action against Google and its parent company, Alphabet Inc., by filing a significant antitrust lawsuit. The lawsuit alleges that Google has abused its monopoly power in digital advertising technology markets, negatively impacting publishers and distorting auction mechanisms, ultimately harming content creators and the public interest.
According to Business Insider, Google has maintained dominance in critical segments of the ad tech infrastructure, particularly publisher ad servers and ad exchanges, through various practices that result in decreased revenues for publishers while increasing Google’s profits. A 2025 ruling from the Eastern District of Virginia found Google guilty of engaging in anticompetitive actions to monopolize these markets.
Key points highlighted in the complaint include Google’s control of more than 90% of the global publisher ad server market through DoubleClick for Publishers (DFP) and its 60-70% share of the ad exchange market with DoubleClick Ad Exchange (AdX). Publishers, including Business Insider, are allegedly compelled to utilize DFP and participate in AdX to access advertisers at scale.
Business Insider’s complaint outlines specific practices employed by Google to suppress publisher revenue, such as the implementation of Dynamic Allocation where AdX is prioritized over other ad exchanges, giving competitors limited opportunities to compete. Additionally, Google allegedly engaged in “Last Look” insider trading by manipulating AdX’s bidding to outperform competitors, exploiting inside information about rival bids.
Following the introduction of a “Unified Auction” structure and “Minimum Bid to Win,” Business Insider claims that Google used past data to rig future auctions in favor of AdX, ultimately diminishing the price publishers received for impressions and hindering fair competition among ad exchanges.
The lawsuit against Google includes allegations of monopolization of publisher ad servers and ad exchanges, attempted monopolization, and unlawful tying practices. Business Insider also presents state law claims, including deceptive business practices, common-law fraud, and unjust enrichment, all aimed at securing monetary compensation and court orders to reform Google’s business practices.
This legal action is part of a series of challenges to Google’s ad-tech business, with previous lawsuits and regulatory actions focusing on similar antitrust claims. The litigation landscape in the digital advertising realm continues to evolve, with an increasing emphasis on competition and fair market practices.
