Mount Airy Casino Resort faces lawsuit for owing more than $5 million in wages to table games dealers

West Scranton High School in Pennsylvania was put on a two-hour delay due to a threat that was reported on February 11, 2025, at 9:34 am. Additionally, a potential class-action lawsuit has been filed against Mount Airy Casino Resort in Monroe County for allegedly withholding over $5 million in wages and overtime from its table games dealers.

The lawsuit, filed in U.S. District Court in the Middle District of Pennsylvania on February 7, claims that Mount Airy Casino Resort did not pay its table games dealers the applicable minimum wages and overtime they were owed. The two plaintiffs, Jennifer Mak and William Neidig, filed the complaint individually and on behalf of others in similar situations. They allege that the casino violated the federal Fair Labor Standards Act, the Pennsylvania Minimum Wage Act, and the state Wage Payment and Collection Law.

The lawsuit accuses the casino of several unlawful practices, including improperly claiming a tip credit against federal and state minimum wage and overtime obligations without informing employees, distributing pooled tips to non-tipped supervisors, rounding time clock hours to the casino’s advantage, and miscalculating the regular rate of pay for overtime purposes. The plaintiffs argue that Mount Airy Casino Resort willfully violated these wage laws.

If the class certification is granted, current and former employees who fit the criteria will have the option to voluntarily join the lawsuit as co-plaintiffs. The lawsuit, which consists of nine counts, addresses violations under the FLSA, the Pennsylvania Minimum Wage Act, and the Pennsylvania Wage Payment and Collection Law.

The plaintiffs are being represented by three law firms located in Harrisburg, Kansas City, and Missouri. Mount Airy Casino Resort, represented by spokeswoman Nicole Krieger, stated that the resort does not comment on ongoing litigation at this time and had not yet filed a formal response in court.
