Latest update on Capital One class action lawsuit: all the information you need
Capital One Bank is currently under fire due to a class action lawsuit surrounding their alleged improper practices and negligence towards their customers. With the hassle of long lines, hidden fees, and excessive interest rates, the last thing customers want is further issues accessing their funds. Unfortunately, a recent disruption in Capital One’s systems left thousands of customers unable to make transactions, process payments, or receive direct deposits.
Plaintiff Daniel Zepeda took action by filing a class action lawsuit against Capital One on January 22 in the Eastern Virginia Federal Court. The lawsuit claims that the bank’s negligence, breach of contract, and unlawful conduct prevented customers from accessing their funds to purchase essentials like food, clothing, and shelter. The outage, which lasted from January 16 to January 18, coincided with mid-month payments, impacting customers across the country.
The disruption caused significant hardships for customers, leading to struggles to pay for essentials like food, rent, electricity, and gas. Unable to pay monthly debit orders and other expenses, customers faced additional costs due to potential late fees and charges from banks and recipients of payments. The class action suit alleges breach of contract, negligence, conversion, and unjust enrichment, among other violations of consumer protection laws in California.
Represented by Glenn Chappell of Tycko & Zavareei LLP, Zepeda seeks a trial by jury and injunctive relief for affected customers. The class action aims to provide class members with actual damages, interest for late payment, and restitution. While the lawsuit is in its initial stages, the resolution is unclear as Capital One has yet to respond to the charges or determine settlement amounts.
Moreover, the Consumer Financial Protection Bureau has also taken legal action against Capital One, adding to the bank’s legal troubles.
