Tempur and Mattress Firm Increase Slot Commitments per US Judge’s Order
Tempur Sealy and Mattress Firm have agreed to adjust the number of slots reserved for third-party suppliers in Mattress Firm stores if the deal is allowed to close, as recommended by US District Judge Charles Eskridge during the closing arguments. The court noted that the defendants’ slot commitment was lower than what it understood to be the slots occupied by premium third-party suppliers currently, which did not maintain the premerger status quo. In response to this concern, the defendants have committed to the Court that, for five years post-closing, Mattress Firm will uphold the current percentage of third-party premium ($1,500+) slots. This commitment is referred to as the ‘Slot Commitment,’ and it aims to address the Court’s concerns.
