Liberty Mutual Drops Bad Faith UM/UIM Class Action Lawsuit to Streamline Litigation
The plaintiff in a class action lawsuit against Liberty Mutual in Arizona has decided to drop the case, but there are still other legal actions pending. The suit, which was filed in May, claimed that the insurance companies did not properly inform policyholders about their uninsured and underinsured coverages, alleging breaches of contract, good faith, and legal duties. Daniel Capane’s attorney, Robert Carey, mentioned that there are ongoing cases involving Liberty Mutual and Safeco entities, but did not provide further details.
In November, Liberty Mutual filed a motion to dismiss the case, arguing that the claims were outside the statute of limitations. The motion also highlighted a specific incident where Capane requested $300,000 to settle his claim, but only received $100,000 in return. The motion stated that Capane should have filed the suit by December 15, 2019, but did not do so until May 13, 2024, making it untimely.
Even though this case has been dropped, Carey mentioned that they are still working towards finding common ground for resolution in other cases. Liberty Mutual did not respond to a request for comment at the time of publication.
