Former IU Physician Declared Competent in Class Action Lawsuit Against University
A recent ruling in a class action lawsuit against Indiana University involving former Indiana men’s basketball team physician Brad Bomba Sr. has shed some light on the legal proceedings. The judge has declared that Bomba Sr. is competent to provide a deposition in the case.
The lawsuit was filed by former players Haris Mujezinovic and Charlie Miller, who accused Bomba of sexual misconduct. Both players alleged that Indiana University mishandled their complaints regarding Bomba’s behavior. Mujezinovic played for Indiana from 1995-97, while Miller was on the team from 1994-98.
Initially, there was a dispute over whether Bomba would be able to provide a deposition due to his declining health. However, the court ultimately ruled against a motion to prevent him from testifying, citing his ability to distinguish between truth and fiction during the hearing.
Despite some challenges in answering certain questions, such as his age and birthday, Bomba was able to identify other details accurately. This development marks a significant step in the ongoing legal proceedings.
