Class Action Lawsuit Alleges Illegal Levels of Delta-9 THC in Vape Pens

A recent class action lawsuit alleges that Lifted Liquids vape pens might contain unlawful levels of delta-9 THC, which could be risky for users and potentially lead to legal trouble in many states. Delta-9 THC is a compound found in marijuana that is known for its psychoactive effects. While delta-8 and delta-10 THC come from hemp and are legal, delta-9 THC is still classified as illegal in some states.

The lawsuit, filed in the U.S. District Court for the Northern District of Illinois, claims that Lifted Liquids vape pens contain delta-9 THC levels higher than the legal limit of 0.3%, putting users at risk of anxiety, loss of coordination, or even failed drug tests. This poses a threat of arrest and jail time in states like Florida and Texas, where these products are illegal.

The lawsuit argues that consumers believed Lifted Liquids marketing claims that their products contained legal amounts of THC. According to the Plaintiffs, the delta-8 pens actually contained 1.35% to 3.99% delta-9 THC, significantly surpassing legal limits. This misinformation puts users at risk of legal consequences or job loss due to failed drug tests.

The Plaintiffs seek compensation for damages and present multiple claims against Lifted Liquids, including breach of warranty, fraud, and unjust enrichment. The lawsuit highlights the potential risks associated with THC vape pens, including health problems and legal repercussions.

THC vape pens have gained popularity in the U.S., but concerns over negative health effects, such as EVALI, have been raised. The FDA issued a statement in 2019 urging users to stop vaping with THC products due to lung issues. Vitamin E acetate in vape products was linked to respiratory illnesses, leading to EVALI cases and prompting several states to ban its use in vape juices.

As the lawsuit progresses, questions remain about the safety and legality of THC vape pens, emphasizing the importance of transparency and accurate product labeling for consumer safety.
