Class Action Lawsuit Challenges Schweppes, Canada Dry Ginger Ale ‘Naturally Flavored’ Claims

A recent class action lawsuit has been filed against Keurig Dr Pepper, Inc., challenging the company’s marketing of Schweppes and Canada Dry ginger ales as “naturally flavored.” The lawsuit alleges that the beverages are actually artificially flavored with DL malic acid, a synthetic compound processed in petrochemical plants. This information was brought to light in a 41-page complaint, which points out that the labels on these products claim they are made with “other natural flavors” or “natural ginger flavor,” despite containing artificial additives.

The lawsuit argues that under state and federal laws, products must disclose if their characterizing flavor is simulated or enhanced with artificial flavors. In this case, the complaint alleges that none of the Schweppes and Canada Dry products mentioned prominently disclose the presence of synthetic flavoring agents, making them misbranded and illegal to sell. The lawsuit seeks to represent anyone who purchased these beverages in the United States since November 1, 2018.
